Compliance Requirements
All providers of care and suppliers of services participating in the EqualityCare Program must comply with the requirements of Title VI of the Civil Rights Act of 1964, which requires that services be furnished to clients without regard to race, color, or national origin.
Section 504 of the Rehabilitation Act provides that no individual with a disability shall, solely by reason of the handicap:
- Be excluded from participation;
- Be denied the benefits; or
- Be subjected to discrimination under any program or activity receiving federal assistance.
Each EqualityCare provider, as a condition of participation, is responsible for making provision for such individuals with a disability in their program activities.
As an agent of the Federal government in the distribution of funds, the Office of Healthcare Financing is responsible for monitoring the compliance of individual providers and, in the event a discrimination complaint is lodged, is required to provide the Office of Civil Rights (OCR) with any evidence regarding compliance with these requirements.
